A Fiduciary's Perspective



Join us as we discuss difficult interpretation provisions in documents, dig into the grey areas of discretionary distributions, and point out challenging fiduciary decisions. How do you manage risk when making decisions while dealing with difficult beneficiaries and potential incapacity while attempting to maintain the relationship? We will share facts and insights from some of our most difficult cases and like many fiduciary decisions, there is no "one" answer. We will share some ideas for smoother administration and point out troubling trends to avoid.

Gentry B. Byrnes, JD
Co-founder and Chief Fiduciary Officer
Adelphi Trust Company

Gentry is the Chief Fiduciary Officer and Co-Founder of Adelphi Trust Company, the first women owned and managed bank or trust company in Florida. She has a 29‑year legal and fiduciary career most recently serving as the Chief Fiduciary Officer of Raymond James Trust, N.A. managing a team of professionals across the country with over 8 billion in assets. Prior to that, Gentry was the Senior Regional Trust Manager for the Tampa Bay, Sarasota, Naples and Central Florida markets for Wells Fargo, previously Wachovia, and a senior trust officer and team leader at Bank of America.

Gentry started her career with the law firm of Fisher and Sauls, P.A. where her practice included estate and trust administration, estate planning and guardianship. She frequently speaks on fiduciary issues and is very involved in the state and local bar associations. Gentry is passionate about giving back to the community and has served on the boards of Brookwood, A Young Women’s Residence, Great Explorations Children’s Museum as well as leadership roles in her church. She is a past president of both the St. Petersburg Bar Association and Suncoast Estate Planning Council and remains active in both organizations. Gentry is currently the treasurer of the St. Petersburg Bar Foundation, chair of the Will for Warriors program at Stetson College of Law, a founding member of the Professional Fiduciary Council of Florida and a member of the Stetson Elder Law Advisory Board.




Darby Jones, JD
Principal
Professional Fiduciary Services, LLC

Darby Jones is a licensed, but inactive, attorney and a member of the Florida Bar. Darby is also a Florida Registered Professional Guardian. Darby served as a trust officer for financial institutions in Maryland for over 15 years before moving back to her native Florida to establish Professional Fiduciary Services, LLC in 2011. Darby has recently launched Professional Fiduciary Consulting, LLC to support those individuals who have been named in documents but unsure what to do next!

Most recently, in addition to managing her fiduciary and consulting practice, Darby is a Founding Board Member and Executive Board President of the Professional Fiduciary Council of Florida.

Darby is a member of the Executive Council of the Real Property Probate and Trust Law Section serving as Liaison for the Professional Fiduciary Council of Florida. Darby has served as a member of the several committees within the section including Guardianship and Advance Directive Committee and the Ad-Hoc Professional Licensing Committee. Darby graduated from American University, Washington College of Law in Washington D.C. after completing her first year at Stetson College of Law, in St. Petersburg.

Darby is a member the Tampa Bay Estate Planning Council, the Suncoast Estate Planning Council, and the Florida State Guardianship Association. She is also a member of the St. Petersburg, Clearwater, and Hillsborough Bar Associations. As a professional fiduciary, Darby serves in a variety of fiduciary capacities including as Trustee, Agent under Power of Attorney, Health Care Surrogate, Personal Representative, Professional Guardian, and retirement coach.
